This Homes.com listing was created and published by Anna Ly of Sun Realty, the daughter of landlord Phat Tran. The advertisement duplicated the prior Zillow posting (see Exhibit T17) and introduced additional false claims of a “Peek-a-boo Ocean View” and “Pool View.” No such views exist from the property.
The listing also repeated untrue assertions that the property featured new paint, new carpet, and in-unit washer/dryer appliances. In reality, the home contained visible mold (see Exhibits T15–T16), unrepaired roof damage (T14), and missing appliances (T12–T13). These representations misled the tenants into signing the lease under false pretenses, constituting fraudulent misrepresentation and false advertising under California Civil Code §1710(1).
The use of multiple platforms (Zillow and Homes.com) demonstrates a deliberate pattern of deceptive marketing practices by the landlord and agent, designed to attract tenants with amenities and views that never existed. This evidence directly supports claims of fraudulent inducement and violations of real estate disclosure obligations in connection with the 2022 lease.
